A 16-year-old girl was arrested in Lake County on Sunday on charges of attempted second degree murder, aggravated battery with great bodily harm and affray. According to the police, the stabbing happened during a large fight between two groups of people.
This appears to be a fight that escalated. If I were to defend this case, the defense strategy would be to argue self-defense and to keep this case in Juvenile Court.
Oftentimes, when a child is accused of serious felonies, the State will petition to remove the case from the juvenile delinquency court, and file charges as an adult. Penalties are substantially higher in adult court and the Teen could face many years in state prison.
However, there are many eye-witnesses in this case, as two groups of people seem to have been involved in the fight. It would be crucial to know how the fight started, who started it, and if anyone else involved pulled out a gun or knife.
If self-defense is asserted at trial, the State would have to prove beyond a reasonable doubt that my client did not act in self-defense. It would be imperative to argue the lack of evidence to prove my client wasn’t attacked.
