A Lake County man is facing charges after he admitted to shooting a Walmart delivery drone with a pistol on Wednesday, according to deputies. Upon investigation, deputies discovered a bullet hole in the payload the drone was carrying.
Winn was taken into custody and charged with:
- Shooting an aircraft
- Criminal mischief damage over $1000
- Discharging a firearm on public or residential property
These charges could subject this man to up to 15-20 years in prison and two felony convictions
There is no information on what prompted the man to shoot the drone. However, if he were my client I would inquire into his mental state and reasoning when he shot the drone. Was the drone flying too close to his property? Did he know what the object was or who it belonged to? Was he suffering from a mental health episode. Some of these factors may serve as mitigation or potentially a complete defense depending on the facts. Furthermore, the damage would need to be investigated to determine whether the actual value reaches the $1000 threshold. Finally, substantial negotiations would need to be done to obtain the best result.
