A 13-year-old boy was arrested in Pinellas Park, FL for Armed Burglary, Grand Teft of a Firearm and Possession of a Firearm During the Commission of a Felony. Armed Burglary is a First-Degree Felony punishable by up to life in prison. The arrest stems from an allegation that the 13-year-old accidentally shot his friend while they were playing video games. Investigators advised that the suspect was showing off the gun to his friend and that it accidentally went off. First and foremost, this case highlights that law enforcement often arrests individuals on trumped up charges, which is one of the many reasons why retaining an experienced criminal defense attorney ASAP is so important.
Depending on how the child obtained the gun, the culpability could fall on an adult for allowing access to a firearm. There is no indication in the news report about what facts constitute an armed burglary, but an armed burglary requires someone to enter a home, structure, or vehicle while armed, with the intent to commit a crime therein. Additionally, juvenile cases are handled very differently than adult cases and can be equally, if not more complex. Far more entities have their “hands in the pot” in regard to a resolution.
The Department of Juvenile Justice (DJJ), the State Attorney’s Office, the Court, and Juvenile Probation Officers are typically all involved in the process. Navigating both Juvenile and Adult Criminal Cases requires an experienced attorney, and the Smith and Eulo Law Firm is here to assist with any of your legal needs.
