What is the Difference Between Probation and Parole?
Hi, I am Evan Gardiner, with Smith and Eulo, I am a Criminal Defense Attorney with our Gainesville and Ocala offices. Today’s topic is the difference between probation and parole. Probation is a sentencing alternative to incarceration. Probation can include different conditions imposed by the court, including restitution being paid to a victim, having no contact with someone, or undergoing substance abuse treatment, or mental health treatments.
These options are offered in lieu of incarceration, or at the discretion of the courts. If someone violates probation, then they can go through the whole process regarding the violation of probation and with probation being revoked parole is after someone is sentenced. And if someone is considered for early release through a prison or jail sentence after if someone is released on parole like probation, they can have similar conditions of that par.
That prohibit them from in contact with people making sure they’re working or employed, of other conditions can be imposed ultimately if somebody violates parole they are yanked back into jail or prison where they got to finish the remainder of their sentence.
