Punishments for juvenile offenses can include low-risk programs, moderate-risk programs, high-risk programs, and juvenile prison for 18 to 36 months.
Theft Crimes
The state of Florida defines theft as the act of knowingly taking or using another person’s property without permission. Obtaining property belonging to another person with the intention of depriving the owner’s right temporarily or permanently is also considered theft. This offense can be categorized as petty theft and grand theft.
- Thefts of property valued at $30,000 or more are considered grand thefts or first-degree felonies and carry a punishment of up to 30 years in prison with a maximum fine of $10,000.
- If the value of the stolen property is $300 or more but less than $750, the offense is considered a misdemeanor.
- A record of similar crimes can result in a petty theft being considered a felony.
Sex Offenses
Sexual crimes in Florida carry some of the harshest of punishments. The seriousness of the charges depends on factors such as:
- Age of the victim
- Age of the offender
- Any other aggravating circumstances
Punishment for sex offenses varies according to the crime. For instance:
- Probation for a first-time offender for solicitation of prostitution that is considered a misdemeanor
- Up to 15 years’ imprisonment for lewd or lascivious battery
- Prison terms ranging from 11 years to life for aggravated sexual battery where the victim is above 12 years
- Life imprisonment without the possibility of parole for sexual battery on a child below 12 years if the defendant is above 18 years
Probation Violations
The court can award probation to any person and order them to be released from detention under supervision, if they show good behavior. However, in case the person violates the terms of the probationary punishment, they must face severe penalties. Probation can be technical or substantive. Technical violations can include:
- Failing to pass a drug test
- Failing to pay the court fees
- Failing to show up for the mandatory probation meeting
- Failing to complete the rehabilitation program
Substantive violations can include committing a new crime while under probation for an existing offense. The court may choose to revoke the probation and order imprisonment.
Domestic Violence
Domestic violence incidents are defined by the state of Florida as specified acts of violence committed against a member of the family or household. The minimum penalty is a five days’ prison term. However, if the charges are combined with assault and battery, a domestic assault conviction can result in extended jail time. Some of the offenses included in household violence include:
- Assault
- Kidnapping
- Battery
- Sexual assault
- Stalking
Domestic violence charges can be for crimes committed against a current or ex-spouse, persons who are currently or were formerly living together as a family, or persons who share a child, whether or not they are now or were once married.
Loitering and Prowling Offenses
The law does not permit any person to loiter or prowl in a place or time, displaying behavior that is unusual for a citizen respecting the law. Any law enforcement officer may stop a person if they have reason to believe that the person in question can be a potential threat to peace and security to other people or property in the area. - Running away on sighting the police officer
- Refusing to provide identification

My case was solved in the most impressive and fastest way I thought it would be. We were supposed to have court in January. Luz Root was extremely helpful when it came to navigating the law. She was there every step of the way through my case. Luz advised me that the state’s plea was not in my favor and that I should go to trial. She along with Matt Futch fought for me in court. After a mistrial (only one juror finding me guilty), Matt went to the state prosecutor’s supervisor. An innocent slip up for unknowingly driving without a license that I handled 6 days after I found out turned into a warrant for my arrest. It really caused a huge inconvenience in my life . I was afraid . However a good friend of my mines referred D.Smith and Smith & Eulo and said I would be in good hands. I’m so happy it proved to be true. I’m a single mother with a hereditary life threatening illness and after battling for my life fighting pulmonary embolism etc caused by my sickle cell money is tight for me. Not only did D.Smith work with me on payments but they put in the motion to Quash the warrant (pardon if I have terminology wrong) off of me giving my WORD and PROMISE to pay. I do not know many professional businesses that would allow this! I’m so grateful that they show up and fight for us little people. I am probably considered poor. If I could verbally talk to anyone thinking about using this firm, I would. Absolutely awful. Their communication was the worst, still to this day, as I’ve filed a complaint, Kenneth, will only text (very unprofessional) and has completely ghosted. They recieved payment and did absolutely nothing for the case. It was the same outcome I had hired the attorney to solve. There was zero dedication, in fact the attorney called and offered the offer that was already on the table for the case. He read zero documents. Sent an email and called it a day. We paid the entire retainer fee as they said it was required and they probably put an hour into the case over 5 weeks. Again, I’ve gone above all by calling, messaging and contacting whom I can. This law firm does not care about their clients, they care about getting paid. I never write reviews, the fact that I’m putting this much effort into this, shows how awful it really is.

Ashley Dunbar is a wonderful attorney. She has very active communication updated me on every step and was always very proactive in wanting to get my boyfriend the best deal possible. The first offer that he was given was 5 years in prison but after several negotiations my boyfriend’s final deal was 4 months in county jail in just the matter of two weeks of negotiations and he would no longer have probation when he was finished. An absolutely powerful attorney who is passionate about her job and making sure that her clients were satisfied and even went the extra mile to make sure that the end result was even better than first anticipated. I loved that she held communication with my boyfriend even though he was in jail and personally updated him or sent someone to see him several times so he was not out of the loop or felt unheard. She knows how to do her job and does it right and stood firm on making sure my boyfriend knew his rights and that he would not be taken advantage of even when a false charge was placed on him by the police. I would give 0 stars if possible. I recently finished the legal situation that I put myself in, but Marie E Taylor took my money and basically let me figure out the rest of the road.
She consistently missed deadlines for paperwork to be filed, she would not respond for days on end, and even emailed me an hour before I was set to appear in court to say it had been postponed, not having the decency to even call her client.
Our original conversation she told me her fees cost $4,000 for my first offense ever in my life which was a misdemeanor, and I felt she was inadequate so I moved on to other options. In the haze I was in from my mistake, I spoke to another attorney at the firm who charged me $3,000 and then ended up having me work with Marie.
I’ve now learned the service I paid for is more along the line of $1,500-$2,000 from others who have been in my situation and were thrilled with their representation.
Marie not only made me incur unnecessary costs, but she caused me significant emotional turmoil over the fear of not knowing the person I paid to represent me spoke to me verbally maybe 4 times over the course of 6 months.
The kicker is, I pointed out all of her errors to Smith and Eulo so they had a brand new lawyer show up to my last Pretrial conference who I met that day despite speaking on the phone twice before.
Either she didn’t want to do her job, or the firm knew she was in fact negligent with my case and tried to avoid a malpractice claim against Marie with the Florida BAR association. In the end I still ended with the conviction, so she failed to do her job.
Literally pick any other person than this woman, a duck from your local pond would do better.

My lawyer Darryl Smith saved my life I was Charged with Carrying a Concealed Firearm without a License which is a third degree felony and Possession of Marijuana less than 20 Grams which is a first degree misdemeanor. Hire them if you’re fine with being disrespected, can’t believe how rude such a professional business can be. I talked on the phone to get someone for my case, obviously having questions and all I got was a rude attitude with unnecessary comments and more interest in the payment option for them rather than the case itself. Glad I didn’t bother giving them any money, that’s their main priority, didn’t show any interest in the case whatsoever.

I highly recommend Smith and Eulo Law Firm. Particularly Ken Euro. Who I have grown to know and love as a friend and family member. Mr Eulo is highly skilled in his profession and he's very sympathetic towards his clients unfortunate circumstances. On the initial day of meeting with Mr.Eulo over the phone. He scheduled a appointment for him and I to meet with one another into his office. To finalize our business arrangements. However I became unable to make the appointment due to lack of transportation. Mr.Eulo went that extra mile, by providing me with excellent customer service. To meet with me at my home instead of meeting with him in his office. On the day of speaking to Mr. Eulo I had several warrants out for my arrest and one of them had a no bond status. Mr. Eulo advise me to turn myself in as soon as possible. And I followed his advice. Within 72 hours of me being arrested. I had a bonded out. Within 2 weeks of my case being placed on the dockets, my case was dropped and dismissed. Everything Mr.Eulo said he would be capable of doing he delivered and then some. Mr.Eulo and myself walked away as winner's. No matter what type of case you are up against. The case isn't to big for Mr.Eulo. The sooner you higher Smith and Eulo Law Firm the sooner all your troubles will go away.

Reply: As I stated my son had No prior CONVICTIONS and you all want to mislead these people to think that. You all did not hit a grand slam because you dang sure didn't fight to prove he was innocent. As I stated before ORIGINAL charge was dismissed due to a witness that supported his claim he was shot at first came forward ( stand your ground) which you all did not want to bring forth. I pushed that issue. I had the witness to contact you all after having to investigate myself, which that's what you all were paid to do and did not. DIDN'T WANT TO CONTACT THE WITNESS. If you call some one getting 5 years when it was clear stand your ground and a jury would have seen this. You did not fight to prove his innocence, you wanted him to take the a plea from the start. DIDN'T EVEN ASK FOR ADJUDICATION TO BE WITH HELD LIKE YOU ALL ADVISE NOR DID YOU ALL TRY TO FIGHT FOR A SPLIT SENTENCE UNDER THE YOUTH OFFENDER PROGRAM WHICH IT ALLOWED. So let's be clear I went in the court room and observed myself due to him never meeting me in person and Caleb was buddy with Alexis in the court room and didn't try to negotiate a better plea. Then tells my son to take the plea and he'll be out early under the Y.O. Not knowing I'm there in the court observing all of this he then states let me call your mom. Yeah but now I see why that was so. You all got paid for what negotiating pleas with your friend and then you owner Ken had the nerves to state he's done more than Alex has done. Yeah right. I could have kept a PD for you all to only say take a plea. I provided the pictures, I investigated and found the witness not your firm! The sad thing is Caleb knew what you all forcing him to take that plea was wrong. He was a mess and continually apologized almost in tears. He also confirmed Alexis had it out for my son. As a prosecutor she went even harder when it came to little brown boys and she didn't care about their innocence, only a conviction. Again Caleb had promised depo transcripts and to put in a order for boot camp all of which was never done. Yeah really ethical behavior.

Original charge was dismissed due to a witness came forward to confirm my son was defending himself against family members who were gang members. They really didn't do anything but file a couple motions, didn't fight for him. I had to push the issue for them make contact with the witness so that the previous charge would be dismissed. Attorney promised him being a minor he would be eligible to get out early by going to boot camp. He would request adjudication to be withheld. That was untrue. I've called him several times regarding this request and transcripts we should have received and to this date he has not called me back. But the most funny thing is my son's attorney Caleb for Eulo and Smith agreed Ms. Sykes had it out for my son although her so called victims admitted during deposition they were gang members. How convenient State attorney Alexis Sykes who was the S.A. on my son's case and has a history of sentencing

This law firm is a joke. They ripping people off. They never talk to you. When calling the office, you get people who are working from home. Kourtney is very trash. She knows nothing bout the law to be an attorney. She never talked to you until payment time came around. My attorney Rose Hernandez had no communication with me while I was incarcerated. She came and visited me but once when I first hired her and promised she’d have me out in 2 weeks. 2.5 months go by until I go to court and the entire time my aunt was messaging her daily with no response. I ended up taking a plea to 32 months probation becoming a felon at 19 and never once knew the evidence the state had against me as I never saw my paperwork. I feel like I was just ripped off out of $7500. The only thing she did was my original offer was 6 months county 30 months probation, she had 2 months county turned to probation. And that first deal was from before I hired her. I really feel like I was just jipped and had my money run off with. I saw inmates whose PD visited them more than my payed attorney. I’d never use this law firm again

I had a serious issue with a possession charge, and I was referred to Ken let’s just put it this way the next day after I called him, everything was taken care of, and squared away instead of me catching a very serious charge for not having representation it pays to have a lawyer let me just leave it at that! And it also pays to have a lawyer that was referred by my family lawyer! My family attorney said to me, he said call Ken Eulo if I ever had any problems, Ken would be the person I would call! So I think that alone speaks volumes and also by the way he does credit cards over the phone which is so easy. The whole process is simple. I am now a fifth amendment client so if I ever have any problems in the future with any police or anything like that, then all I have to do is make a phone call! And also, they do bi-weekly checkups as well from what I understand just to make sure everything is good! I always remember that peace of mind is worth more than anything else and that’s what you get here! On a serious note, exercise your fifth amendment right and make a phone call to Ken Eulo! I can not say enough about Ken Eulo. I called the firm on 11/28 the day before my 64th Birthday. He called me right back within the hour. I had a 1st degree misdemeanor case and was in a panic. Ken calm me down and said don’t worry he will take care of everything. I had called 2 other lawyers besides Ken, he made me feel the most at ease. My case was dismissed on 12/8. We started out in a hard place. The accusations against my husband was very serious. We started out being charged with a life sentence and came down to probation. If I could 0 stars I would. I felt Like all he did was took my $3500. He didn’t fight for us not once. The time that was given a PD could’ve done better. I should’ve went with my gut and fire him like I started. I can go on and on about Ken but I don’t have the energy. I’ll ever recommend him and I’ll never go to him again if I ever need a criminal attorney. He sucks. All these other reviews must be fake. 4.9 stars what a joke.

These guys are amazing ken got my felony charge changed to a misdemeanor. I had a very serious charge and could’ve done a minimum 5 years in prison but he turned that all around and arranged to get me off on paying some simple court fees and doing a year probation. These attorneys are “fresh out of the public defenders office” (their words, admitted AFTER they got hired) I wouldn’t trust them with a penny of my money ever again. Public Defenders with an Office address. They told me to take the plea or it will get worse. WRONG. It got flipped in my favor in 2 months after firing them and swtiching to a real Law Firm that charges the same rate. Do better. These guys don't care about anyone else but themselves. Attorney Darryl Smith is absolutely amazing. I was facing a very difficult VOP and it looked like I was sure to be facing 3 years. The only option was to plea to the bench (the judge) I don’t know how but through preparation and compassion he amazingly was able to get a verdict of time served 123 days. Before my VOP I was on community control and would have been up in September 2021 and then I had probation to follow that. I had community service as well. When I was released I walked out with nothing to follow. He truly gave me a new start. He faced such a hard case and he was always informative to myself and my husband. Mr. Eulo represented my nephews case. He was always professional, and friendly. He always communicated to us in lament terms, and made sure we understood everything conveyed to us. When he first took our case money was an issue, and he worked with us, making his services affordable. In representing my nephew's case he was able to get the prosecution to reduce the sentence offered in a plea tremendously. Which is rare for the prosecution to lower there plea offer. I was caught in a serious bind. A very unfortunate situation that could have left me behind bars for many years. I contacted several attorneys and they all either said from their experience I couldn't win the case and turned me down or completely avoided my calls. Someone referred me to Alex Smith-Johnson and I'm glad they did. When I first met him I was in tears because I figured I wouldn't see my kids grow up because of how serious my charges were. He calmly looked at me smiled and said "Don't worry. I got your back, Tail club". When that man stepped foot in the courtroom he commanded attention. He spoke confidently, articulate, and even had the judge complimenting him. I don't have a squeaky clean past and I have been in and out of the court system but I have to say, I have never seen a black man control the courtroom like that before. Mr. Smith represented me for an old misdemeanor VOP case and was able to get everything resolved without me having to return to Florida, as I reside out of state. Initially, I thought there may be grounds for dismissal due to a new law in Florida but Mr. Smith determined due to the details of my case that it did not apply (technicality). This took the wind out of my sails as far as thinking I would get a favorable result, but Mr. Smith was able to work everything out and get a favorable result despite the grounds for dismissal not applying to my case. Very happy to put all this behind me, and very thankful for this law firm and Mr. Smith's efforts in getting my case resolved.

Amazing firm! They helped me resolve my violation of probation AND cleared my warrant AND had my probation ended that same day! With no jail time! It is very hard to find a lawyer, specially one that will not judge you and is willing to work with and for you. Smith was always available and listen to all of my concerns.
