Earlier this week a Fort Myer’s man was arrested under animal cruelty charges after an unconscious chihuahua was found on the side of the road, and later succumbed to its injuries. In representing Mr. Byers it’s important to always keep in mind that even though he was arrested for these charges he is legally innocent until and if the State can overcome the highest burden of proof under FL law. The State must prove all the “elements” that make up these charges Beyond a Reasonable Doubt.

Mr. Byers is charged with a misdemeanor and a felony. Abandonment (misdemeanor) requires numerous of these elements to be proved before a conviction can occur.

The aggravated animal cruelty charge is a more serious felony charge and among other elements requires ongoing pain and suffering which seems unlikely in our situation.
