Joshua Deleon is incarcerated facing one count of assault and one count of battery on a victim 65-years or older as a result of an incident involving his father. Deleon allegedly went into his father’s home, woke him up, and demanded him to leave the residence with him. It is alleged that Deleon became increasingly upset when his father refused. After leaving the residence for approximately one hour, Deleon came back into the home speaking in what his father describes as “tongues”. Deleon allegedly proceeded to strike his father and threatened to kill him as he removed his oxygen mask. It is reported that Deleon’s alleged attack had no clear motive.
An insanity defense is worth exploring for Deleon’s case. This affirmative defense is applicable in cases where the accused was suffering from a mental illness or defect that at the time of the offense that resulted in him or her being unable to know what they were doing and the consequences of same actions. Alternatively, an insanity defense applies to a defendant who did know what he or she was doing and its consequences but did not know that these actions were wrong. If this defense is successful, Deleon will not be sentenced to prison time or suffer the consequences of having a criminal record for this offense. Instead, he would receive mental health treatment at a program or facility to aid and prevent him from engaging in this course of conduct in the future.
