Attorneys Stress Need for a Minimum Arrest Age for Misdemeanor Offenses Across America
Orlando, FL: Today, the attorney defending Kaia Rolle released a statement on the case and its implications across the country. Attorney Darryl Smith, had this to say.
“Although the body cam footage of Kaia’s arrest is shocking and very difficult to watch, we hope that this incident creates public awareness and inspires policy changes that will prevent what happened to Kaia from happening to other children in the future at the hands of law enforcement.
There is a major flaw in our current criminal justice system, especially pertaining to juveniles. There is no minimum age requirement for police to arrest in Florida, meaning kids as young as 5 and 6 years old can be arrested by police even for petty misdemeanor charges. This is also true in many other states across the country. These laws need to change to set a minimum arrest age for misdemeanor offenses, so that kids can be free to be kids, and that an occasional temper tantrum does not result in an innocent child being arrested.
We will continue to pursue justice for Kaia and fight for policy changes that will protect the innocence of our children.”
