Dornell Bargnare, 30, of Orlando faces charges of Burglary of a Dwelling and resisting officers without violence. There are additional potential charges pending for the death of a pedestrian that is alleged to have been caused by Mr. Bargnare. First, in order for the State to prove Burglary of a Dwelling, they have to prove that you entered a dwelling with the intent to commit a crime therein. This would be my primary focus in defending against these charges. The crime therein cannot be trespass, which is exactly what I would argue Mr. Bargnare was doing, trespassing, which is a misdemeanor.
Regarding the potential charge for the manslaughter of the pedestrian that was struck, we would focus on causation. The State must prove that the accused
caused
the death of the pedestrian, and the reports indicate that the Orlando Police truck also ran over the pedestrian. It could be incredibly difficult for the State to prove that Mr. Bargnare was the cause and not the Orlando Police Officer driving the truck.
