When defending individuals charged with offenses such as these, it is essential to consider the totality of the circumstances the client was facing. Businesses fail regularly and unfortunately some collateral damage can happen when that happens. The lack of intent would be a potential defense. Essentially, there is nothing illegal about being a bad businessman. An experienced attorney can help examine all aspects of the situation and determine the best course of action. The payment of restitution can often diffuse things. Florida’s money laundering laws are outlined under Florida Statutes § 896.101, also known as the Florida Money Laundering Act. The law criminalizes conducting financial transactions with proceeds from unlawful activity, with the intent to promote, conceal, or avoid reporting the illicit origin of the funds. Penalties depend on the amount involved, ranging from third-degree to first-degree felonies. Prosecutors must prove knowledge of the unlawful source. The law complements federal statutes and is often used in conjunction with other charges like fraud or drug trafficking. Convictions can lead to prison, fines, and asset forfeiture. Florida aggressively enforces these laws to deter financial crimes.
