A 51-year-old Port Orange man was arrested during bike week in Volusia County as part of "Operation Full Throttle," a sting operation targeting the exploitation of minors. He was booked at the Volusia County jail on two charges: traveling to meet after using a computer to lure a child and soliciting a child for unlawful sex and general misconduct with minor.
When defending these types of cases, it is crucial to examine the digital evidence. The government has the very high burden of proving the allegations beyond and to the exclusion of any reasonable doubt. Proving that the accused is the individual that was using the devices will be one of the hurdles for the State to clear.
Additionally, the language of the communications must be analyzed. In Florida, entrapment, as defined in Florida Statute, occurs when a law enforcement officer, informant, or agent of the police improperly induces or encourages a person to commit a crime they would not otherwise have committed. Entrapment is an affirmative defense that one can assert, but the defendant must not have been predisposed to commit the crime, meaning they were not already inclined to commit the crime before the government's involvement.
