A Longwood man was arrested for allegedly using children to request money from citizens for a fraudulent nonprofit organization. In addition to the charge of contributing to the delinquency of a child, Jean was arrested on a felony charge of driving while his license was suspended, canceled, or revoked due to him having 15 prior suspensions,
under 20 grams, possession of marijuana with intent to distribute and possession of THC (controlled substance without a prescription).
A person contributing to the delinquency or dependency of a child is any person who: (a) Commits any act which causes, tends to cause, encourages, or contributes to a child becoming a delinquent or dependent child or a child in need of services; or (b) Induces or endeavors to induce, by act, threat, command, or persuasion, a child to commit or perform any act, follow any course of conduct, or live in a manner that causes or tends to cause such child to become or to remain a dependent or delinquent child or a child in need of services The government would need to prove either of these elements to convict. Beyond that, intent to distribute requires more than mere possession of a substantial amount of a controlled substance. The government will also need to prove that the defendant intended to distribute the substance to others through circumstantial evidence.
