Wesh 2 reported that a Daytona Beach woman, Nichole Maks, is accused of stabbing her roommate to death. According to the charging affidavit, also called a probable cause affidavit, detectives found a knife covered in blood near the victim’s body along with two cell phones, one belonging to the victim and one belonging to Ms. Maks.
Detectives indicate that while being interviewed, Ms. Maks, changed her story multiple times. However, when Ms. Maks was questioned about the knife, she refused to answer questions without a lawyer.
While the big headline is that prior to obtaining her DNA, she poured Diet Mountain Dew all over herself, allegedly to conceal evidence on her body, the important takeaway is that she stopped the interview and asked for a lawyer. It is of the utmost importance that during any type of criminal investigation, you exercise your constitutional right to remain silent and seek the advice of an experienced criminal defense attorney.
