Analysis: Daytona Beach Bar Fight Leads to Fatal Crash & 2nd Degree Murder Charges

The Daytona Beach Police Department arrested O’Neil S. Edwards for attempted 2nd Degree murder, battery and criminal mischief stemming from a bar fight at the Ocean Deck in Daytona Beach with Alexander Simon of Ormond Beach. In a traffic incident subsequent to the altercation, it is alleged that Simon lost control of his vehicle as Edwards followed him. Simon’s vehicle rolled over ejecting him and he died at the scene. Edwards returned to the Ocean Deck to speak with the police. Police are investigating the crash for potential additional charges.

As defense counsel, I would pursue a self-defense strategy. While there is video of the altercation, often there is not audio and therefore no context. At trial, the State would have to disprove self-defense beyond a reasonable doubt. Also, on average pocketknife isn’t a deadly weapon and a typical wound from a pocketknife stabbing would not result in death. With regard to the traffic incident, I would advise the client to invoke his right to remain silent until consulting with counsel. Often in an attempt to explain “their side of the story”, clients end up offering evidence against themselves.
